The employee's duties must coincide with his or her job category and position as reflected in the payroll and employment contract.
As we have already been informing, as of April 1, 2023 workers no longer have to submit the TI sick leave report to the company, and it will be the INSS who will inform the company/manager of the workers’ sick leave by electronic headquarters, at the latest, the day following the date of the sick leave, and with the new communication procedure, the company is now obliged to report “the description of the functions in their job position“.
IMPORTANT: From now on the company has to report the description of the functions in their job position and they must check that the functions currently performed by all their workers coincide with the professional category and job position that they currently have and that appears in the pay slips, since the functions performed by the workers have to be within their professional group and job position and now this information will go directly to the National Security Institute and the General Treasury of the Social Security that can check the professional category to see if there are cases of under contribution.
If the functions performed by an employee are not within his or her professional category and job position, please contact your labor advisor to correct it.
